  • Hair coloring, highlights, and blonding services
  • Hair extensions
  • Consultations for color and extension services
  • Retail hair care products (Davines product line)

Services are provided at our salon location by appointment only. Pricing and availability vary by stylist.

3. SMS/Text Messaging Terms

By providing your mobile phone number and opting in to receive text messages from Oliver & Co Salon, LLC, you agree to the following terms:

3.4 Opt-Out Instructions

You may opt out of receiving text messages from Oliver & Co Salon, LLC at any time by using any of the following methods:

5. Services and Appointments

Services are provided on a per-appointment basis. Pricing is available at the salon or through our online booking system. Our cancellation policy requires 24 hours notice. A 50% fee applies for cancellations within 24 hours, and a 100% fee for no-shows.

6. Pricing and Payment

Pricing for services is set by each stylist and is available at the time of booking. Payment is collected at the time of service. We accept cash, credit/debit cards, Apple Pay, Venmo, and Zelle.

7. Refund Policy

If you are dissatisfied with a service, please contact us within 48 hours. We will work with you in good faith to address your concerns.

7.1 Termination by Oliver & Co Salon, LLC

We reserve the right to terminate or suspend Services at any time if:

  • You breach these Terms
  • You engage in illegal, fraudulent, or abusive conduct
  • Continuing the engagement would violate applicable law or our ethical standards

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of the engagement. This includes, but is not limited to, personal details and service history.

Confidentiality obligations do not apply to information that:

  • Is or becomes publicly available through no fault of the receiving party
  • Was known to the receiving party prior to disclosure
  • Is independently developed without use of confidential information
  • Is required to be disclosed by law or court order

9. Limitation of Liability

9.1 Disclaimer of Warranties

SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, OLIVER & CO SALON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLIVER & CO SALON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.3 Cap on Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO OLIVER & CO SALON IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

9.4 Third-Party Services

We are not liable for any issues, damages, or losses caused by third-party platforms, software, or services, including but not limited to outages, data loss, or changes to functionality.

10. Indemnification

You agree to indemnify, defend, and hold harmless Oliver & Co Salon, LLC and its owners, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Your breach of these Terms
  • Your violation of any applicable law or regulation
  • Your use of the Services
  • Your interactions with other clients or salon visitors

11. Dispute Resolution

11.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us at legal@oliverandcosalon.com and attempt to resolve any dispute informally for at least thirty (30) days.

11.2 Governing Law

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of laws principles.

11.3 Jurisdiction

Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Maui County, Hawaii, and you consent to the personal jurisdiction of such courts.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oliver & Co Salon, LLC regarding the subject matter herein.

12.2 Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or by posting notice on our Website. Your continued use of our Services after such modifications constitutes acceptance of the updated Terms.

12.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

12.4 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

The relationship between Oliver & Co Salon, LLC and its Clients is that of independent contractors. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
